The rules for using this website. Your rental itself is governed by your written quote.
Last updated: October 2026
These Terms of Use ("Terms") govern your use of evergreeneventrental.com (the "site"). Evergreen Event Rental is a trade name of Geranium Street USA, Inc., based in Escondido, California ("we", "us", "our"). By using the site or sending us an inquiry, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the site.
PLEASE READ THE "DISPUTES" SECTION CAREFULLY. IT REQUIRES MOST DISPUTES TO BE RESOLVED BY INDIVIDUAL ARBITRATION, NOT IN COURT, AND IT WAIVES CLASS ACTIONS.
Who may use the site
You must be at least 18 years old to use the site or send us an inquiry. If you use the site for a company or organization, you confirm you have authority to accept these Terms for it.
Rentals are confirmed in writing
The site describes what we rent and how we price it. Nothing on it is an offer, a quote or a contract, and sending an inquiry doesn't reserve anything. A rental exists only when you and we accept a written quote or rental agreement for your event. That document controls the rental, including price, schedule, delivery, setup, strike, deposits, cancellation, damage and liability, and it takes priority over anything on the site.
We may decline any inquiry or rental for any lawful reason.
Prices, availability and errors
Rates on the site are starting rates for the panels or pieces themselves. Market minimums apply, and delivery, setup and strike are quoted per event. Rates, minimums, products and availability can change at any time without notice. If the site shows a wrong price or description, we may correct it, and we are not bound by the error.
Custom hedge letters
Custom hedge letters, names and logo shapes are made to order and sold, not rented. You keep them after your event. Each one is quoted per project, and the terms in your written quote apply.
Planning information is not professional advice
Guides, panel math, layouts and examples on the site are general planning information. They are not engineering, structural, fire-code, permitting, insurance or legal advice. You are responsible for venue approvals, permits, site conditions and your own event's safety requirements, except where your written rental agreement says otherwise.
The Design Studio, estimates and images
- The Design Studio is a planning tool provided as is. Its layouts are drawings, not photographs, and its estimates are not quotes. You are responsible for checking measurements, panel counts and fit for your venue before relying on a layout.
- When available, our in-house team can prepare photorealistic mockups. They are illustrations of a proposed design, not photographs of a finished build, and the finished build may look different.
- Case-study photos show builds we delivered. Some other images on the site are illustrations or renderings that show how a product can look. Foliage color, texture and finish can vary from what you see on screen.
What you send us
When you send us information, floor plans, logos, artwork, wording or other materials, you give us permission to use them to respond to you, prepare quotes and produce your order. You confirm you have the right to share them, and that anything you ask us to reproduce, such as a logo or a name on custom hedge letters, doesn't infringe anyone's trademark, copyright or other rights. Don't send anything you don't want us to see or keep.
Using the site
You agree not to:
- Use the site or its forms for anything unlawful, or send false, misleading or spam inquiries
- Try to disrupt, overload, probe or get unauthorized access to the site or our systems
- Scrape or copy the site with automated tools, except search engines indexing it
- Copy, republish or sell our photos, text, drawings or designs without our written permission
We may suspend or block access to the site for anyone who breaks these rules.
Our content
The site and its text, photos, drawings, designs, logos and the Design Studio are owned by Geranium Street USA, Inc. or used with permission, and are protected by intellectual property laws. We give you a limited, revocable, non-transferable permission to view the site and use it to plan your own event and request a quote. All other rights are reserved.

Disclaimer
THE SITE, ITS CONTENT AND THE DESIGN STUDIO ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT, AND WE DON'T PROMISE THE SITE WILL BE ERROR-FREE, SECURE OR AVAILABLE. Any warranties for a rental are only those stated in your written rental agreement.
Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, GERANIUM STREET USA, INC. AND ITS OWNERS, EMPLOYEES AND CONTRACTORS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100).
Claims about a rental are governed by your written rental agreement, including its own limits. Nothing in these Terms limits liability for fraud, willful injury or anything else that California law doesn't allow to be limited.
Indemnity
You agree to defend, indemnify and hold harmless Geranium Street USA, Inc. and its owners, employees and contractors from any claims, losses, damages and costs, including reasonable attorneys' fees, arising from your misuse of the site, your breach of these Terms, or materials you send us, including any claim that a logo, name or artwork you asked us to reproduce infringes someone else's rights.
Disputes
Talk to us first. Before starting any claim, email [email protected] with a description of the dispute and give us 30 days to try to resolve it.
Arbitration. If we can't resolve it, any dispute arising from or relating to the site or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, held in San Diego County, California, or remotely. The Federal Arbitration Act governs this section. The arbitrator decides any question about whether a dispute must be arbitrated.
Exceptions. Either side may bring an individual claim in small claims court, and either side may go to court to stop infringement of its intellectual property.
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding, to the fullest extent the law allows.
Opt-out. You may opt out of this arbitration agreement by emailing [email protected] within 30 days after you first use the site or send us an inquiry, with your name and a statement that you opt out of arbitration.
Time limit. To the extent the law allows, any claim arising from the site must be brought within one year after it arises, or it is permanently barred.
Governing law and venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. For anything not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California.
General
- We may change these Terms at any time by posting the new version here with a new "last updated" date. Changes apply from that date, and using the site afterwards means you accept them. Changes don't apply to a dispute already in progress.
- If any part of these Terms is found unenforceable, the rest stays in effect, and that part is enforced as far as the law allows.
- Our not enforcing a term isn't a waiver of it.
- You may not transfer your rights under these Terms. We may transfer ours, for example if the business is sold.
- We aren't responsible for delays or failures caused by events outside our reasonable control.
- These Terms and the Privacy Policy are the whole agreement between you and us about the site. A signed rental agreement governs your rental.
